Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website at https://srilankarealestate.lk and any related mobile applications or services operated by SriLankaRealEstate ("we", "us", "our"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

1. The Platform

Sri Lanka Real Estate is an online property marketplace connecting property owners, real estate agents, developers, buyers, renters, and investors across Sri Lanka. We provide a technology platform to facilitate property listings, lead generation, and communication. We are not a real estate agency and we do not participate in property transactions.

2. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must provide accurate, complete, and current information during registration.
• You must not impersonate another person or use a name you are not authorised to use.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Listing Rules

All listers must:

• Only list properties they own or have explicit written authority to list on behalf of the owner.
• Ensure all listing information (price, size, location, photos, features) is accurate and not misleading.
• Upload only genuine photographs of the listed property — stock images are prohibited.
• Comply with all applicable Sri Lankan property laws and real estate regulations.
• Not include personal contact details (phone numbers, email addresses) in listing descriptions or photos.

Prohibited listings include:

• Properties involved in legal disputes without appropriate disclosure.
• Properties listed without the legal right to sell or rent.
• Duplicate listings of the same property by the same or different accounts.
• Fraudulent, misleading, or scam listings of any kind.

4. Listing Plans and Payment

• Private owners must pay a listing fee before their listing is submitted for moderation. Applicable fees are as published on the platform and subject to change with 14 days notice.
• Agent and Developer subscription plans are billed monthly via PayHere. Subscriptions auto-renew unless cancelled with at least 7 days notice before the renewal date.
• Listings are only published following successful payment confirmation and passing of moderation.
• Refunds are issued within 3–5 business days if a listing is rejected during moderation. No refunds are issued for listings that pass moderation but are subsequently removed for Terms violations.
• Pay Per Lead (LPL) charges for developers are invoiced monthly based on verified leads received.

5. Moderation

All listings are subject to review by our moderation team before going live. We reserve the right to reject, edit, or remove any listing that:

• Contains inaccurate, misleading, or incomplete information.
• Violates any provision of these Terms.
• Uses prohibited photos (e.g. stock images, images of other properties).
• Duplicates an existing active listing.
• Is reported by users as suspicious or fraudulent.

Moderation decisions are final. Rejected listers may re-submit a corrected listing. Listers who repeatedly violate our policies will have their accounts suspended or permanently banned.

6. Leads and Buyer Communications

• Lead information (buyer name, phone, message) is shared with the listing owner, assigned agent, or developer as applicable.
• You must not use lead data received through our platform for any purpose other than responding to the specific property inquiry.
• Bulk marketing, spamming, or selling of lead data obtained via our platform is strictly prohibited and will result in immediate account termination.
• We do not guarantee the quality, genuineness, or intent of any buyer or tenant lead.

7. Intellectual Property

• All content on the platform (design, code, logos, branding, and text created by us) is owned by SriLankaRealEstate and protected by applicable intellectual property laws.
• By uploading content (photos, descriptions, documents) to the platform, you grant us a non-exclusive, royalty-free, worldwide licence to display and distribute that content solely for the purpose of operating the platform and promoting your listing.
• You retain ownership of your content. You warrant that you have the rights to all content you upload and that it does not infringe any third-party rights.

8. Prohibited Conduct

You must not:

• Use the platform for any unlawful purpose or in violation of any applicable law.
• Attempt to scrape, harvest, or data-mine platform content without our express written permission.
• Introduce malware, viruses, or other harmful code to the platform.
• Circumvent or attempt to circumvent any security, authentication, or access control mechanism.
• Engage in any conduct that interferes with other users' access to or enjoyment of the platform.

9. Limitation of Liability

Sri Lanka Real Estate provides the platform on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or that any defects will be corrected. To the fullest extent permitted by Sri Lankan law:

• We are not liable for any direct, indirect, incidental, or consequential loss arising from your use of or inability to use the platform.
• We are not a party to any property transaction and accept no liability for the conduct of any buyer, seller, agent, or developer.
• We are not responsible for the accuracy of user-generated listing content, including prices, photos, or descriptions.

Our maximum aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Dispute Resolution

We encourage users to resolve disputes directly. If you have a complaint about a listing, another user, or our service, contact us at privacy@srilankarealestate.lk. We will use reasonable efforts to resolve complaints within 14 business days. These Terms are governed by the laws of Sri Lanka. Any legal proceedings must be brought before the courts of Sri Lanka.

11. Termination

We may suspend or terminate your access to the platform immediately and without notice if you breach these Terms, engage in fraudulent or illegal activity, or pose a risk to the safety or integrity of the platform. You may close your account at any time in accordance with our Account Deletion Policy.

12. Changes to These Terms

We may revise these Terms from time to time. We will notify registered users of material changes via email or platform notification. The updated Terms will be effective from the date of posting at https://srilankarealestate.lk/terms. Continued use of the platform after that date constitutes acceptance of the revised Terms.
